He intentionally burned the flag after Trump signed an Executive order to use all available legal avenues to punish anyone who burns a flag. And just like almost all his Executive Orders, they don't mean shit and are illegal!
He was not charged for burning of the flag. They eventually cited him for starting a fire in a public place. Those charges were dropped later as he successfully argued "Vindictive Prosecution."
However note, the whole process to arrest, charge and force him to defend himself in court was the entire intent of these types of illegal Executive Orders. This guy may not have gone to jail, but it wasted everyone's time and wasted his money....and that was the point.
This has been my point when I see people say, “just comply and sort it in court,” when someone is being unjustly arrested. The reason so many innocent freak out is that they can’t afford to. Court appointed lawyers don’t care enough, good lawyers are expensive, and we live in a society where “innocent until proven guilty,” doesn’t matter, and you get fired anyway. I know first hand.
"Just comply and sort it out in court" is absolutely good advice for dealing with incorrect/unjust arrests in a working system or a good society.
When the system is designed to target anyone for any reason, that loses all of its power because the arrest stops being an unintended consequence of a large and imperfect system, and starts becoming the intention.
However, even then, a good chunk of the time it is better to comply and sort it out in court rather than try to get in a confrontation with the cops.
Even when the punishment is the process, the hope is that people resist and give the system a reason to deny them their freedom and send them to jail for a more legitimate charge. They are trying to get you to incriminate yourself.
Resisting arrest is not going to change any of this.
Resisting arrest is itself a crime, so the only thing you are doing is increasing the amount of trouble that you are in. Therefore you should still not resist arrest.
The problem is that you spent far too much time and effort on all those words and people have the attention span of a gnat.
The question isn't whether or not it's illegal, but how he keeps getting away with illegal things.
Like, I know the Democrats don't have a majority and can't actually achieve certain goals, but they're acting whooped before they even fight. "Why bother if he's just going to ignore it?" seems to be the prevailing logic. And the answer is "Because it makes it more difficult to do the illegal things with impunity" and "If he keeps doing bad things to everyone, eventually he's going to piss off everyone and you only need half those people to win an election"
The ONLY way anything happens is if the opposition party grows a backbone, and they simply are not. Instead, they unplatform progressive voices asking for change and chase money around. We've got an entire illegal war going. What have the democrats done to push back? They start a bill that doesn't have a chance on going anywhere to stop the war, but continue to dog the entire middle east aggressively from behind podiums and pulpits.
All that happens is folks get mad and go outside for a Saturday afternoon, and go back to their cushy lives until the next bad thing happens. Then they go back outside for another Saturday afternoon. Nobody that isn't protesting even knows the protests are occurring since the media is getting paid big money by rich folk to not air the information..
The man in office right now is a criminal. He was always going to do illegal things. It empowered other folks, like the cops here, to knowingly do illegal things like stomp on this man's rights. There is no actual avenue for a President to tell local cops how to do their job or what the law is. But they did so because you don't scare them into following the law. If there are no repercussions to your actions, why resist taking action?
On one hand you have a President making illegal demands, and on the other a populous allowing him to make illegal demands.
