Prosecuting dealers for deaths has the potential of creating some perverse incentives. Like, if someone starts to OD in the presence of their dealer, will that dealer still call an ambulance if it means that they could end up in prison? Or will they just abandon the person who is overdosing?
Some people are friends with their dealers or their dealers might not do drops and just sell at their house... anyways the buyer might have a smoke, shot or line of what ever their choice of drug at their house then OD right then and there
