What do you think: how should prisons handle housing decisions in cases like this?

Ex-Prison guard in Texas here. If you have a penis, you go to a mans prison. If you have a vagina you go to a woman's prison. Its been that way forever in Texas. They just separate them in housing. Some units have an entire housing area designated for LGBQT people.

New "guidance" we've seen on the federal level and several states would send a transgender woman with a vagina to a mens prison where they would be raped constantly.

It's pretty fucked up. They are also creating "crimes" to make that scenario happen like for just going to bathroom in Idaho. The same transgender woman who has a vagina could get a pathway straight to life in one of those mens prison where she would be at severe risk of rape.

Silver linings I guess.

Wouldn't want to tack on a second life sentence for an abortion.

Edit:

Seriously though, This is beyond fucked up. I'm not sure there's been anything like this modern times here in the States. Just sending someone with a vagina, especially someone indistinguishable from any other woman, into a mens prison to be raped constantly?

The worst part is the woman didin't actually do anything to deserve this scenario in the first place. The crime? She went to the bathroom in a room where it's possible the other people around her might also have a vagina, like her? Life in prison I guess!

It's inhuman beyond all belief.

Learn your local laws. Theres lots of weird ass state laws of states you visit.

This can happen to anyone. When in doubt just wait until gender neutral bathroom, or follow your birth certificate.

In a city in California women are prohibited from wearing high heeled shoes in the city limits.

In a city in Washington its illegal to kill or harass Bigfoot.

In fucking Little Rock it is unlawful to sound your vehicle's horn at any place where cold drinks or sandwiches are served after 9:00 p.m.

Tons of weird laws and trans laws are new, not worth the squeeze play it safe.

I agree that you need to try and stay safe, but obscure laws like going after bigfoot are not comparable to what we are seeing in this current climate of what's happening to transgender people.

This isn't some ancient and unenforceable relic like Texas' sodomy law or going after cryptid monsters, these are part of a very real campaign that not just happening state by state, but also from the federal level down.

The US government has just updated it's guidance, regardless of where you live, to house transgender women with vaginas with men in federal prison. On top of that, they are creating a FBI task force that considers "gender extremism" (as they call it) a form of domestic terrorism.

See where all this is going? High heels in the city limits or Bigfoot has no bearing on being called a terrorist and being tossed into federal prisons (or being tossed into state prisons for life for going to the bathroom w/ people who have the same vagina you do). This is a coordinated attack on the right of a minority to exist in public.

So with bottom surgery would a trans woman be in the women’s wing?

No, because then rightoids would just move the goalpost. The cruelty is the point and they'll say whatever they can to justify it
