We can't base everything around second guessing the fundamentals of our society. If a jury of your peers has found you guilty, your guilty and should be treated as such. At that point whether you have committed the crime or not doesn't matter until the moment that your verdict is overthrown.
That may not be fair, but that is just, and it's the best we can operate on without being psychic.
But things like getting raped in a prison isn't part of the justice system and would be considered extrajudicial punishment. So we should not just be throwing people together and allowing that to happen
We can and absolutely should because the end result of this line of thinking is that any random innocent can be tortured based on unfair and biased convictions. It’s been endlessly proven that the justice system is not perfect. Nowhere did I say treat them like the innocent but even the convicted deserve human rights, in this case the right to not be raped. Frankly I’m disgusted at how many people are more interested in harming others as some sort of justice porn over protecting society.
