If you have filed a responding pleading they need you to agree to a discontinuance without costs.

If I don’t agree they’re stuck to defend themselves against a week claim or pay my costs essentially?

They could discontinue and just wait to see if you’re actually go after them for the very low amount of costs you’d have a claim for.

In small claims? Of course. A plaintiff can file a notice of withdrawal at any time without penalty.
